Alexander Rich successfully defended on appeal an unlawful detainer action brought by a commercial landlord seeking to evict a longtime tenant.
The tenant had entered into a 10-year lease, which included an option to renew the lease for another 10-year term. About four months before the first 10-year term expired, the landlord gave notice that the tenant’s option to renew the lease had been revoked and that the firm’s client would need to move out at the end of the first term. The trial court entered judgment in the firm’s client’s favor. The landlords subsequently appealed the decision, but the Mendocino County Superior Court’s Appellate Division unanimously upheld the trial court’s judgment and awarded the firm’s client further attorney’s fees and costs associated with the appeal.
