Alexander Rich and Jared Carter obtained an award of more than $125,000.00 in attorney fees after prevailing on a motion for summary judgment in defense of a local real estate developer.  Mr. Rich and Mr. Carter successfully argued that the language in the Association’s Covenants, Conditions & Restrictions (CC&Rs) allow for owners of any lot to vote in elections, whether or not the property has improvements.  After prevailing on the summary judgment motion, Mr. Rich filed a motion for attorney fees pursuant to the Davis-Stirling Act and pursuant to the CC&Rs.  The Honorable Jeanine B. Nadel granted the motion, determining that the firm’s clients were prevailing parties and that their request for attorney fees was reasonable.
