Brian Carter and Colin Morrow successfully demurrered to all causes of action brought against their client by former commercial tenants.  The tenants claimed that their right to exercise an option to purchase leased property had been impaired by a defect to record title despite their never having attempted to exercise the option.  The tenants also claimed that the landlord had breached a right of first refusal held by the tenants despite the landlord never having entered into any contract to sell the real property.  Though the tenants were granted leave to amend, the Court noted that it “sincerely doubt[ed] that Plaintiffs can cure the defects raised by the demurrer but will allow one final opportunity.”
